A settlement has been reached with Church & Dwight, in a class action lawsuit about alleged benzene contamination in some of its Batiste™ dry shampoo products.
Church & Dwight denies the lawsuit's allegations, and denies any wrongdoing, but has agreed to the $2.5 million (€2.28 million) settlement in order to avoid costs and "distractions associated with continuing this case".
The lawsuit is captioned Evans et al. v. Church & Dwight Co., Inc., Case No. 1:22-cv-06301, pending in the United States District Court, Northern District of Illinois.
The move potentially enables customers who purchased the product to claim a refund.
If Bare™ Products or Batiste™ Products were purchased for personal, family, or household use and not for resale prior to 30 May 2023, consumers are entitled to receive their money back - if they can provide proof of purchase.
Those unable to provide proof of purchase could receive $2 (€1.8) per product up to five products, for a maximum payment of $10 (€9.1).
A valid claim form must be completed by 15 November 2023.
The final approval hearing for the settlement is scheduled for 16 October 2023.
